Sacramento just put its first hard number on the table. On Aug 12, Governor Newsom released an outline of a utility-liability package that would cap non-economic damages at $150,000 for wildfire victims who were "in harm's way" but didn't lose property, curb plaintiff attorney fees, and — the part carriers actually care about — restrict insurers' subrogation rights. There's still no bill text, and the Legislature adjourns Aug 31. The backdrop is enormous: Eaton losses pegged at $24–45B, and California's $21B Wildfire Fund expected to be drained.

The insurance side moved too. The California FAIR Plan won an approved 29.1% homeowner rate hike (effective Oct 15), against $768B of exposure and as little as $200M in cash. And Southern California Edison's Eaton reprieve firmed up: the inverse-condemnation question is now headed to a 2027 jury trial. For one carrier the stakes are already concrete — Mercury General is counting on $538M of Eaton subrogation recovery, precisely the channel Newsom's outline would narrow. Follow the money.

A $768B book on a few hundred million in cash runs on reinsurance and cat bonds — bullish for ILS capacity, and a rate signal admitted carriers will follow.

The abstract Sacramento debate has a concrete price tag on a single insurer's balance sheet — multiply it across the market to see the stakes.

The other half of Edison's week: a credit-downgrade warning — the Eaton ruling lifted EIX 3.1%, but the bigger money question is credit: Edison has warned that California's investor-owned utilities face credit-rating downgrades if lawmakers don't pass wildfire-liability reform by the Aug 31 deadline — downgrades that would lift borrowing costs and, eventually, rates (Aug 2). A jury's discretion sets the ceiling on Eaton exposure; Sacramento's next 18 days set EIX's cost of capital — that's the number utility bondholders are actually trading.

ILS yields keep tightening into peak season — the catastrophe-bond market yield fell to about 9.29% by end-July on seasonal spread tightening, with no new wildfire-specific bond priced in the Aug 11–13 window. Wildfire-exposed issuance still stands at $5.183B YTD, near 2025's $5.55B record. Tightening spreads mean cheap, plentiful protection heading into fire season — good news for sponsors like the FAIR Plan, thinner margins for ILS funds.
